If bot detected order older then yours (defined by order id which increments with any order installed) and not abandoned (updated a few hours ago) bot will not outbid this order. You can check order with price 1227 and quantity 401:

I would tell that red flag is when you run bot around a clock. Need to mimic human and have nights when bot never works and days. About VM, CCP may ban new account created under VM during ban waves when botters loose bot farms and start to create new accounts in bulk. Old accounts not checked against VM, but this may change in the future. If you have possibility to use real comp, better to use real comp.

If there are several active competitors will this not mean the bot will never update the order?

"First come first serve" principle. You outbid orders, but created after you order when you have priority. If bots start to outbid each other income will get burned with relist fee.

No, but depending on the trade volume for this item and quantity of items updated in the market this may take too long.

I cannot tell which order was created by bot or human. Orders created by bots should follow "first come first serve" principle or they will eat all profits with relist fee. Try to split your time into 2-3 short (1-1.5h) login intervals during a day. This way bot will detect more orders which were not updated during the past 12h and may outbid them despite "first come first serve" principle
